Madonna won a copyright lawsuit that claimed a horn melody in her song ?Vogue? was illegally used. It was claimed that Shep Pettibone, the song?s producer, used the same horn sample he used in another one of his songs. Circuit Judge Susan Graber stated, ?A reasonable jury could no conclude than an average audience would recognize an appropriation of the ?Love Break? composition.?
